The Research On Administrative Coercive Measures Of The Public Health Emergencies

In recent years, the public health emergencies frequently occur.Because of its public nature, they often cause significant harm on people’slives and health, social stability and the country’s economy stable.Administrative coercive measures used in public health emergenciestimely can prevent and control the epidemic, maintain social order andprotect safety of citizens. Therefore administrative coercive measures aregetting more and more used. However, if administrative coercivemeasures are improper used, they would likely to cause expansion ofexecutive power and prejudice the right of the counterpart. In order toeffectively prevent and control public health emergencies, China hasdeveloped a series of laws and regulations, which have numerous entriesfor the administrative coercive measures, and often difficult to select inpractice.Firstly, we studied the relevant laws and regulations. Then analyzedand summarized the current situation of the administrative coercivemeasures in public health emergencies, and found the problems at the legislative level, the implementation level and the level of rightsprotection. Further gave the suggestions for how to reasonably adjust theadministrative coercive measures in public health emergencies, and gavethe medical science propose amendments to the existing law in the fieldof public health. Finally, achieve the fundamental goal of administrativecoercive measures.
