| From “trial by newspaper”,“trial by mass media”to “trial by public opinion”（or “public opinion trial”）,“trial by public opinion” has it own history.Further more,Sina micro-blog has always been an important supporter of public opinion.Today,in the internet era,social conflicts are occurring frequently and people deliver their opinions constantly by Sina micro-blog.Public opinions emerge wave after wave.These opinions keep bringing the events to trials.People judge these social conflicts by advanced defining,criticizing related objects,making the judicial trial more efficient,or revealing and solving the social problems.Inevitably,the public opinion on Sina micro-blog will bring some negative effects.We must comprehend the cardinal principle of the “trial by public opinion” of the social conflicts if we want to control it effectively.Therefore,this text will start with the development and connotation of “trial by public opinion”.In order to comprehensively analyze the issue of "trial by public opinion" in the micro-blog of social conflict events,this paper first summarizes the two key concepts — "trial by public opinion" and "social conflict events" and defines the connotation of their concepts,so as to make the later part of the discussion reasonable and tenable.Both of them are divided into "development history" and "concept definition".Among them,the concept of "social conflict events" involves related theories of sociology.This paper uses a lot of literature as its theoretical support.After the completion of the research review,this paper discusses the theme.First of all,it discusses the elements of "public opinion trial".This paper summarizes the elements of "public opinion trial" into three aspects: who will be the judge,who will be judged,and how to judge.In the process of analyzing the mechanism of micro-blog "public opinion trial",this paper combines the "public opinion trial" of micro-blog of social conflict events with the judicial trial in the legal theory,refers to the mechanism in the judicial trial,and sums up the "public opinion trial" mechanism by analogy.Among them,some important analogies in this paper are the analogy between opinion leaders and "presiding judge",the analogy between micro-blog public and "jury",the analogy between micro-blog public opinion confrontation and "accuser and defender",the analogy between "public opinion trial" and "public trial" and "closed trial" in special circumstances.These analogies can clearly and intuitively show the mechanism of "public opinion trial" in micro-blog of social conflict events,and how the multiple roles it contains interact with each other.In this chapter,this paper takes a number of social conflict cases,collects a large number of data for its corresponding "public opinion trial",and makes a quantitative analysis of these data,so as to make the analogy between journalism and law more credible.In addition,this paper further dialectically analyzes the specific impact of "public opinion trial" of micro-blog on social conflict events,including positive and negative impacts.In the discussion of positive influence,this paper focuses on the new way of "public opinion trial" to reflect social problems,"public opinion trial" to promote information integration,"public opinion trial" to supervise the fairness and justice of judicial trial,etc.;in the discussion of negative influence,this paper focuses on the confusion of public and private topics,the wrong value orientation caused by irrational views,and rumors that reduce the credibility of the media.Finally,according to the results of the above discussion,this paper puts forward some practical measures to guide and control the "public opinion trial".Including the basic countermeasures,there are also innovative new ideas.The innovative formulation of this chapter,such as improving the service efficiency of the government micro-blog,improving the quantitative public opinion monitoring indicators,and strengthening the platform push disinformation.These innovative ideas are based on the discussion of "public opinion trial" on micro-blog of social conflict events in this paper.To a certain extent,they are sometimes new and can produce a reference value for practice. |
