Research On Legal Issues Of Rural Domestic Waste Management In Shanxi Province

The report of the 19 th National Congress of the Communist Party of China stated that in order to achieve the goal of bluer sky,clearer water,greener mountains and more beautiful villages,we must give priority to the development of agriculture and rural areas,implement rural revitalization strategies and build beautiful China.The improvement of village appearances plays an important role in the construction of beautiful villages.Nowadays,many domestic wastes are dumped at random in rural areas,so the treatment of rural household wastes has become a key link to improve the appearance of villages.Dingxiang County,Shanxi Province is selected as the The empirical research object hopes to find out the main legal problems in the treatment of domestic waste in rural areas of Shanxi Province through analysis of the current status of rural waste management in Dingxiang County,so as to propose perfect suggestions for the problems in order to solve the rural areas in Shanxi Province.The phenomenon of “garbage surrounding the village” has played a certain role in promoting,so as to achieve the goal of beautiful village construction as soon as possible.When conducting research in Dingxiang County,the author found that the following problems existed in the treatment of domestic waste in rural areas: First,the multi-principle provisions of relevant laws and regulations cited in the process of rural waste treatment in Dingxiang County lacked operability in practice.,Leading to the blind reference to the relevant provisions of urban domestic waste management in rural household waste management.The second is that the responsibilities of multiple departments will be involved in the treatment of rural domestic waste,but due to the unclear division of responsibilities,unmanned management often occurs.In addition,the treatment of rural domestic garbage requires long-term operation,but due to the lack of effective incentives,the implementation of grassroots is not strong enough,and it is often in a state of stagnation.Third,the education level of rural residents is generally low,and there is insufficient understanding of the hazards caused by the random dumping of household waste.The fourth is the lack of effective supervision of the government's governance effects and the dumping behavior of the villagers,which has not been enough to cause the government and villagers to pay more attention to the management of rural domestic waste.Taking the issue as the guide,after drawing on the advanced governance experience of Japan and some successful counties in China,the author puts forward the following suggestions for improvement: First,we must speed up the improvement of the relevant laws and regulations and the local laws and regulations of the treatment of rural household garbage in China,so as to be as specific as possible,It is convenient for practical operation;secondly,it continuously improves the law enforcement at the grass-roots level,so that the main responsibilities of the law enforcement body are clear;secondly,it is necessary to fully mobilize the enthusiasm of the public to participate in and play the role of the public in the treatment of rural domestic garbage;Improve legal supervision channels.
