Research On The Construction Of Arbitration System For Environmental Pollution Disputes In My Country

At the same time of economic development,environmental pollution disputes are also developing.These environmental pollution disputes have become a problem of people's life.The problem we have to face now is how to coordinate the relationship between economic development and environmental protection.We need a reasonable and appropriate way to effectively solve environmental pollution disputes,which is not only related to the parties involved in environmental pollution disputes,but also has a great connection with the stability and harmonious development of society.There are several ways to solve environmental pollution disputes,such as mediation,consultation,litigation,etc.these three kinds of environmental pollution dispute resolution mechanisms have their own advantages for such a long time,but it is undeniable that these three kinds of dispute resolution mechanisms also have certain defects,and arbitration just can complement with them,so that environmental pollution disputes can be solved timely and effectively Arbitration itself is characterized by flexibility and fairness.The main body of this paper is divided into four parts.The first part introduces the concept and characteristics of environmental pollution disputes through Suzhou environmental pollution disputes arbitration case,and analyzes the reasons why the development of China's environmental pollution disputes arbitration system lags behind.The second part is mainly from the theoretical and practical aspects to further clarify the specific problems that need to be solved in the construction of China's environmental pollution dispute arbitration system.The third part is the research on the arbitration system of environmental pollution disputes in four foreign countries,namely,the United States,Japan,South Korea and Brazil.Through the research on the arbitration system of environmental pollution disputes in these four countries,we can find out the Enlightenment on the construction of thearbitration system of environmental pollution disputes in China.In the fourth part,through the study of foreign arbitration system of environmental pollution disputes,combined with China's national conditions,the author analyzes China's environmental pollution disputes arbitration from theory and practice,and puts forward feasible and necessary suggestions.
