In mid-December 2012,my government formally submitted to the United Nations Secretariat its claim regarding the ownership of the continental shelf in parts of the East China Sea.The main demand content is to hope that the Commission on the Delimitation of the Continental Shelf can adopt a reasonable method to divide the continental shelf in the East China Sea.The conflict between China and Japan has gradually unfolded,and the competition and influence of strategic interests such as abundant oil and gas resources and huge economic and military interests contained in the continental shelf have slowly surfaced.The continental shelf is the land covered by the sea,which is the natural extension of a country along the coastal land under the sea water to the sea.Because of the overlap between China and Japan in the delimitation of the continental shelf in the East China Sea,whether it is based on the view of the principle of natural extension represented by China or the rule of the intermediate line of the equal distance line represented by Japan,the premise of the demarcation must be based on the principle of fairness.The reason goes back to the fact that,in the 1980 s,the United Nations promulgated the United Nations Convention on the Law of the Sea,in which the limits of the continental shelf of States around the world were included.Through the analysis of the cases concerning the continental shelf disputes that have emerged in recent years,the reasons for the judicial settlement of the International Court of Justice are summarized.The legal status and effect of the Diaoyu Islands and Okinawa trough in the Sino-Japanese continental shelf dispute has become the focus of the study on the settlement of legal problems in the dispute over the delimitation of the continental shelf.In addition,it is important to sum up the countermeasures of domestic law and international law in the dispute between China and Japan,and finally to find a balance between friendly consultation and the judicial settlement of the International Court of Justice.The continental shelf in the East China Sea is abundant in resources and has great interests.China must firmly stand by China,adhere to the principles of “shelving disputes,jointly developing” and natural extension,jointly safeguard the interests of the East China Sea with Taiwan compatriots,and strive to find suitable international legal countermeasures to facilitate the early acquisition of the advantages and victory of the dispute over the delimitation of the continental shelf in the East China Sea.
