On The Modification Of The Will Of The Insurance Beneficiary

With the rapid development of China's insurance industry and the enhancement of consumers' insurance awareness,more and more families will choose life insurance contract to obtain the insurance benefits after death.The purpose of life insurance contract is long-term.In the long life process,based on various factors,the insured is prone to change their emotions,and then change the insurance beneficiary.In practice,there are frequent cases of changing the insurance beneficiary by will,but the insurance law and relevant judicial interpretation of our country do not clearly stipulate the effect of this change form,and do not explicitly prohibit it,which leads to different judgment results in similar cases.Based on the existing legislation,this paper aims to clarify the problems in the case of changing the insurance beneficiary by will through several cases.Through the legal theory research on the system of changing the insurance beneficiary,this paper discusses the effect of changing the insurance beneficiary by will,draws the conclusion that the insurance beneficiary can be changed by will,and puts forward some suggestions and ideas in order to construct the will change The system of insurance beneficiary shall be improved to further protect the legitimate rights and interests of both parties to the contract of the insurer.
