On The Expert Assistant System In Our Country's Criminal Procedure

In the criminal procedure law revised in 2012,the "expert conclusion" was changed to "expert opinion".This change shows the essential attribute of the evidence of the expert opinion,which must be cross-examined before it can be used as the basis for determining the facts of the case.However,the occurrence of a series of unjust,false and wrong cases also highlights the existence of many problems in the expert opinion,which seriously damages the judicial authority.In this context,in order to adapt to the needs of practical development,the system of expert assistance came into being.As an emerging system,China's expert assistant system plays an important role in making up for the deficiency of the judicial expertise system,balancing the rights and obligations of both sides,helping the court to determine the facts of the case and promoting judicial justice.However,the operation time of the system of expert assistant person in the criminal procedure law of our country is short,the legislation is not perfect,and many problems in the process of judicial practice still need to be solved.Through the introduction of the operation status of relevant systems outside the region,we can find out the shortcomings of China's current system of expert assistant person,and further standardize and improve China's system of expert assistant person.
