| At present,the main social problems in our country facing the aging of the population growing as a result of labor market supply,retired workers again obtain employment problem has become a focus of attention of the public in the retired re-employment of high-profile compensation and laborer’s rights but also theoretical controversy,from that country through the system design is necessary to unify balance problems in real life,to improve and guarantee the continuous development of social economic system to adapt to the new labor force structure patterns.However,in the current legislation of our country,there is no specific provision for specific analysis and response to the practical problems caused by the re-employment of retired workers,so the corresponding contradiction has become an urgent problem to be solved at the present stage.This article will carry on the research from the following four aspects to the legal problem of the retired reemployment personnel.Firstly,it expounds the meaning of retirement and reemployment,and further defines and explains its types,functions and legal nature.Secondly,it sorts out the historical reform of relevant laws and regulations in China and discusses the three legal problems at present.After that,it lists relevant legislative policies outside the region,mainly including the relevant provisions of the United States,the United Kingdom and Japan.Finally,the paper puts forward some Suggestions to solve the practical dilemma and realize the sustainable development of our country’s economy and society. |
