Since the 21st century,China is accelerating into the aging population society,According to data released by the National Bureau of Statistics,China's working-age population of 16-59 years of age is 896.4 million in 2019,accounting for 64.3% of the total population;249.49 million people are aged 60 and over,accounting for 17.9% of the total population.Compared with the previous year,the total working-age population has fallen and the ageing has continued to deepen,the number of retirees is increasing.In recent years,people's living standards have improved and their physical fitness has been enhanced.Although the situation of reemployment after retirement is increasing day by day,the state has not issued complete and systematic laws and regulations on the legal status of retired reemployment personnel,labor rights and interests protection and other legal issues.With the increase of labor disputes among retired and re-employed personnel,some abuses of China's current labor law also gradually appear,which is can't protect labor rights and interests of retired reemployment.This paper discusses the labor rights and interests of retired and re-employed personnel from four parts.Firstly,this paper defines the meaning of reemployment after retirement,analyzes the types of reemployment after retirement,and introduces the five theoretical disputes about the relationship between retired reemployment personnel and employing units,and analyzes the necessity of guaranteeing the labor rights and interests of retired reemployment personnel.Secondly,it lists the foreign laws and regulations on the protection of labor rights and interests of retired and re-employed personnel.Followed retired reemployment in China labor rights and interests protection legislation present situation and existing problems of analysis,analysis of China's current retired reemployment labor rights and interests of people with disabilities,four sorts of problems is not clear legal status,is difficult to apply the provisions of labor standards,inductrial injury relief difficult to achieve,lack of again obtain employment management agencies;Finally is to perfect our country labor rights protection law retired re-employment personnel's suggestion,in thatretired re-employment personnel for the special relationship between labor relationship with unit of choose and employ persons,put forward the standard retirement again obtain employment personnel salary standard,perfect again obtain employment personnel working vacations,retirement security retirement again of inductrial injury insurance rights and interests of employees,and set up specialized agencies regulate re-employment program several Suggestions,hope to be able to better safeguard the rights and interests of retired re-employment personnel labor.
