On The Judicial Review Of Administrative Disputes Over The Demolition Of Illegal Buildings

In recent years,both rural and urban areas in China have witnessed the growth of illegal construction,so it has become the focus of administrative organs to control illegal construction for a period of time.The related legal issues have become the focus of research both in theory and practice,but in general,there are few articles from the perspective of judicial review on the performance of administrative disputes and review rules of illegal construction demolition.This paper studies a large number of practical cases,summarizes the main points of administrative disputes caused by illegal construction and the review rules of judicial organs,especially the main rules of the supreme people's court for the trial of illegal construction,and reflects on the choice of judicial review methods and reasons for the demolition of illegal construction administrative disputes.Through the analysis of the judicial practice,it is found that the administrative organs should cooperate with each other to control the illegal construction disorder within the scope of legal provisions and responsibilities,so as to promote the modernization process of urban and rural planning steadily.
