Research On The Leniency System For Plea Guilty And Punishing In The Review And Prosecution Stage

Since the establishment of the system of leniency pleading guilty and punishment,how to promote the simplification of procedures and the rational allocation of judicial resources in the application has become the focus of criminal litigation.The article focuses on the review and prosecution stage,starting from typical cases,through theoretical and practical research on the leniency of pleading guilty and punishment by consulting literature and field investigations.It mainly analyzes three problems: the application scope of the request for leniency is limited,the protection of the defendant's rights is insufficient,and the scope of the sentencing proposal is different.On this basis,the author starts from four aspects: expanding the scope of application of guilty plea,improving the protection system of the right of the accused,standardizing sentencing Suggestions and improving the supervision mechanism of guilty plea put forward perfect suggestions for reviewing the application of the system of leniency in pleading guilty and punishment at the prosecution stage.
