Research On The Professional Security System Of Judges In The Grassroots Courts In My Country Under The Background Of Judicial Reform

On November 12,2013,the Central Committee of the Communist Party of China deliberated and passed the decision of the Central Committee of the Communist Party of China on several major issues of comprehensively deepening reform,marking the beginning of a new round of judicial system reform in China.The judge's professional security system is an important part of the judicial system reform.At present,the judge's professional security system in our country is relatively backward,so we should increase the reform of the judge's professional security system.As the main force of China's court system,the grass-roots judges undertake the most important case trial work.However,the judges of the grass-roots courts are faced with the risk that the trial power is restricted by the power of all parties,the judges are transferred at will,the economic income is relatively low,and the overload working state and revenge are in danger.These problems need to be solved urgently.Therefore,this paper focuses on the perspective of grass-roots judges,and makes an in-depth analysis of the professional security system of grass-roots judges.Based on the background of judicial reform,this paper makes a survey of 60 grassroots judges in the form of questionnaires,and takes the conclusions drawn from the survey as the basis of this writing.In addition,the paper also uses literature review,comparative analysis and other methods to conduct an in-depth study on the professional security system of grassroots judges.This paper includes three parts:introduction,four chapters and conclusion.The introduction mainly discusses the background and significance of the topic,the research status at home and abroad,the research methods and the existing innovation points and shortcomings.The first chapter mainly expounds the related concepts of the professional security system of the grass-roots judges,and further analyzes the content and significance of the professional security system of the grass-roots judges as well as the legal basis of the professional security system of the judges,which provides theoretical support for the writing of the article.The second chapter mainly carries on the empirical investigation to our country's basic level judge's professional security system,thus carries on the thorough analysis to the current situation,the existence question and the reason of the basic level judge's professional security system,has pointed out the direction for the following writing our country's basic level judge's professional security system proposal.The third chapter is a theoretical analysis of the professional security system of judges in foreign countries,and summarizes the experience that can be used for reference to improve the professional security system of judges at the grass-roots level in China.The fourth chapter,based on the research results of the first three chapters,puts forward some concrete measures for the improvement of the reform of the professional security system of the grass-roots judges in China.The conclusion part mainly summarizes the content of the article and my point of view.Through the analysis of the full text,it finds that there are still some problems in the current professional security system of judges in the grass-roots courts of our country.Based on the empirical investigation of the questionnaire and the beneficial experience research on the professional security system of judges in foreign countries,it puts forward the measures to improve the professional security system of judges in the grass-roots courts of our country Application.In order to ensure that judges exercise their judicial power independently,the court should reduce the interference of external administration and reform the judicial committee system;in order to stabilize the identity of judges,the court should adjust the tenure of judges and implement the tenure of judges in stages.In order to improve the income of judges,the court should establish a separate financial system and wage system to get rid of the economic constraints of the administrative organs on the court;in order to ensure the personal safety of judges,the court should strengthen the security facilities,and strengthen the education of law popularization for the people.Strengthening the professional security system of judges at the grass-roots level can solve the problems existing in the process of independent exercise of judicial power of judges at the grass-roots level,at the same time,it can also strengthen the stability of the identity of judges,improve the income of judges,ensure the personal safety of judges,enable judges to devote themselves to the work of case trial,and create a professional and professional group of judges.So as to establish the judicial authority,promote the reform of the judicial system,and further realize the general goal of running the country according to law.
