Research On Natural Conservation Easements

The protection and utilization of natural resources is a major problem in today's world,and it is also an urgent problem for all countries to solve.For a long time,our country mainly relies on the public law control means or the administrative enforcement measure environmental protection method,but the effect is not satisfactory.In order to improve the guarantee function of institution to the sustainable development of human society,it is necessary to analyze and study the easement system of nature conservation which is popular in the world.According to the actual situation of our country,the advantage of the easement system is that it combines the economic value and the natural resource value.To be specific,this paper introduces the existing easement system in China,analyzes and combs the public easement system of the transition system,and introduces the easement system of nature conservation to be constructed in the nature conservation land.This paper introduces the international development of this system and the mature easement system of American nature conservation.This paper analyzes the land ownership structure of natural protection land and the management dilemma caused by the problem of land ownership in natural protection land.This paper analyzes the feasibility of easement system of nature conservation and discusses it with the practice.The nature conservation easement is a kind of other real right acquired by the obligee through signing the nature conservation easement contract with the servitude holder in order to achieve a certain nature conservation goal and restrict the specific land use method.The servitude shall perform its contractual obligations,that is,to protect the land resources of the natural protection land,and shall not destroy the ecological environment of the natural protection land for personal interests,and the easement holder shall have the right to pay remuneration and supervise the land on a regular basis.When constructing the content of easement system of nature conservation,the subject,object,content of right,change rules and safeguard measures are designed.It is expected that the easement system of natureconservation will play an effective and positive role in China's nature conservation.
