Research On My Country's Fair Competition Review System

There are two key factors in the contemporary market economy in China.One is the market system and the other is fair competition.The two have a huge internal correlation,of which fair competition is the guarantee of a market economy.One of the national functions is the economic function.It not only requires the state to directly protect the competition law system of market entities,but also requires the establishment of laws and regulations that can restrict the behavior of managers,including a fair competition review system.In real society,administrative monopoly,illegal assistance,local protection,internal transactions,and other restrictions on competition exist widely.Although the "Anti-Monopoly Law" can curb acts that affect fair competition to a certain extent "after the fact," it cannot eliminate the negative effects that have been caused.The establishment of the fair competition review system shows its unique superiority.Whether from the aspect of maintaining a fair market competition order or improving the existing anti-monopoly system,the fair competition review system also has "predefense" "Function and" post-correction "effect.In the trend of comprehensively deepening reform,China's fair competition review system still needs to be further improved and implemented.On June 14,2016,the State Council formally issued the "Opinions on Establishing a Fair Competition Review System in the Construction of the Market System"(hereinafter referred to as "Opinions on Establishing a Fair Competition Review System"),and China officially established a fair competition review system.In the first part of the thesis,the basic theory of China's fair competition review system is explained in detail,and the characteristics and functions of the fair competition review system are analyzed.The second part of the thesis is mainly about the current situation of the fair competition review in China and the shortcomings of the system.The third part of the thesis is a detailed analysis of the experience and enlightenment of fair competition review systems in other countries.It consists of four parts: first,the European Union's implementation of the state aid control system;second,the Australian experience of competition compensation mechanisms;third,the South Korean evaluation system;and fourth,the Japanese evaluation system.Summarizing the above information,in the fourth part of the dissertation,we thoroughly analyze China's fair competition review system and put forward specific optimization suggestions.As the main body of policy review,the government can ensure the smooth application of the fair competition review system through scientific and strict review standards and review methods.Of course,it also needs the corresponding supporting system to support it.This part mainly includes the improvement of the review mechanism and the disclosure of review information;the soundness of the fair competition review process;the refinement of the fair competition review content;and the use of the rigidity of the fair competition review system to achieve thorough fair competition.China's fair competition review system is still in its infancy,and there are still many things that need to be improved.Only through continuous theoretical accumulation and practical summary can we ensure that the fair competition review system gradually matures and improves.
