At present,the debate on the monopoly of the Internet platform industry has never stopped.The anti-Monopoly law enforcement organs in other countries,accused Microsoft,Google,Visa and other companies for monopolizing the market or abusing of dominant market positions;China also has Qihu 360 sued Tencent for abusing of dominant market positions,and Renren in Tangshan sued Baidu in Beijing for monopolizingthe market,etc.The two-sides market's characteristics of the Internet platform made it difficult to apply the traditional anti-monopoly theory in the traditional single market,which poses new problems and challenges for platform companies' anti-monopolyrules.The systematic rules of anti-monopoly for Internet platform companies,especially in definingthe relevant markets and determiningthe market dominance,haven't been formed yet.This article takes the classic case of Internet platform antitrust as a starting point and under the guidance of China's Anti-monopoly Lawabout the determination of market dominance,and takes the effective legislative experience of the European Union,the United States and other countries as a reference to propose the perfection of the determination of market dominance of Internet platform enterprises Policy.In view of this idea,the article has divided into four chapters by the author:The classical case of anti-monopoly in China's Internet platform-Qihu 360 sued Tencent for abusing of dominant market positionsis the first chapter of this article.By analyzing the case and the focus of the dispute,it summarizes the internal and external causes of such cases.The second part mainly analyzes the plight of the current market dominance determination of Internet platform enterprises,and conducts a systematic study on the basic link of antitrust regulation,that is,how to accurately define the relevant market.On the basis of sorting out and summarizing the basic theories of relevant markets and market dominance,the difficulties of defining relevant markets and determining market dominance in the context of the Internet are analyzed.The third part mainly analyzes the relevant experience of extraterritorial anti-monopoly organizations have defined the relevant marketand determined the dominant market positionof the Internet platform enterprises,which can provide a reference for China to improve the determination of the dominant market position of Internet platform enterprises.The fourth part mainly considers and summarizes the above problems,and provides reference for perfecting the determination of market dominance of China's Internet platform enterprises.
