Under market economy system,competition between enterprises intensified.The credit sales model is becoming the mainstream.Credit sales form credit economy,credit economy needs a social environment of good faith.A credit society means that enterprises with good faith can obtain more business opportunities and profits and ensure sustainable development,while enterprises without credit stop going forward,bankrupt or try to recover credit.Since China's entry into the WTO,with the rapid development of China's economy,the market economy is booming,various business forms,however the corresponding credit environment has not been established.Enterprises establish their own legal department and credit control department to supervise the credit sales in order to collect accounts receivable timely and avoid bad debts.Since the economic crisis in 2008,the number of litigation cases arising from contract breach has been increasing year by year.The reasons are mostly related to customer's credit,and enterprises credit needs to be improved.The improvement of enterprise credit cannot be separated from legal regulations.Compared with China's rapidly developing economy,China's laws and regulations related to credit have not kept up with the current situation.Enterprise credit problems,especially small companies face more credit problems.On the one hand,these problems restrict the healthy and sustainable development of enterprises and harm the socialist market economy;on the other hand,malicious default enterprises escape from legal sanctions,form a bad social demonstration role and destroy the socialist economic order.So it is necessary and urgent to improve the legal regulation of enterprise credit.From the perspective of general enterprise credit control,this paper considers the reasons that restrict corporate credit enhancement and the case materials of untrustworthy enterprises accumulated over the years,and proposes three major legal issues.Analyze the cause of the problem,compare the foreign credit system and legal regulation to find similarities and differences,consider the applicability of China's national conditions,and demonstrate and propose suggestions for improving the existing corporate credit legal regulation.The first chapter is divided into two parts.In the first part,the status quo of enterprise credit law regulation is analyzed.In the second part,three major problems restricting enterprise credit are found from the legal system of enterprise credit investigation,the legal system of enterprise credit supervision and the legal system of enterprise breach of credit punishment.They are: 1.The unclear legal provisions make the financial data into the credit collection report a gray area.2.Internet credit investigation is lack of supervision.3.It is difficult to implement legal punishment for malicious and dishonest enterprises.The second chapter focuses on solving unclear legal provisions caused the financial data into credit collection report a gray area.Discusses the standards and reasons that should be included in credit report,and puts forward the methods and suggestions that financial data should be included in credit collection report.The third chapter expounds the supervision of Internet credit enterprises,discusses the necessity of Internet credit supervision,the key points and difficulties of supervision,and puts forward the feasibility and ideas of how to break through these difficulties.Finally,it puts forward suggestions for Internet Credit supervision.The fourth chapter try to find a solution to the implementation of legal punishment for malicious default enterprises.Firstly,it points out the defects of the existing regulations of "discrediting person" and "restrictions on high consumption",and then case study of how to crack the difficulty of execution,and finally puts forward the suggestion.
