With the continuous upgrading of the Internet era and the development of big data,China’s Internet enterprises have developed rapidly,and the number of Internet users has increased sharply.China has become the largest Internet users’ country all over the world.At the same time,in order to obtain the profits of competition,all walks of life have entered the online market,which is also known as the online market.In the development of the times,a large number of Internet companies have emerged.Among them,a number of companies have developed search engines and search platforms as their main businesses.The bidding ranking is one of their main method to obtain profits.Participants often add various false propaganda and vicious propaganda activities to the background,in order to expand the attractiveness of their products and services,indirectly destroy the goodwill,reputation of competitors.Not a few Internet users can’t identify whether it’s True or False,which has created many legal questions and legal risks.As an important law of the market economy,the Anti-Unfair Competition Law should carry out reasonable regulation for improper competition in the online bidding ranking.The main body of this paper consists of three parts,as follows:The first part,that is the first chapter,is mainly to point out questions involving problems of bidding ranking.The problems mainly involved three aspects in the bidding ranking.The first is the problem of the bidding ranking itself.The second is the problem of the bidding ranking’s provider,that is,the problem of the service provider.And the third is the problem of the users of the bidding ranking,that is,the advertisers’ problem.In addition to these three aspects,there are still many other problems.Most of these problems involve unfair competition,and the root cause of unfair competition is mainly economic benefits,as well as some technical reasons.In order to help readers to understand the Internet technology products of bidding ranking,this chapter gives a brief overview of the nature of bidding ranking and the status of development.The second part,that is chapter two to four,mainly combines the current "Anti-Unfair Competition Law" to legally analyze the problems of online competitive bidding ranking,which involves unfair competition behavior.At the same time of analysis,the author also quotes relevant cases in recent years and conducts case study to analyze the cause of the problem more vividly.At the same time,based on the current concept of big data,the author will use the relevant professional platform to search the relevant case types to provide further analysis.Because there are many types of unfair competition behavior,this article focuses on three types,confusing behavior,false propaganda behavior,and misunderstanding propaganda behavior.Except for these three categories,this article does not analyze others too much.The third part,that is the fifth chapter,tells proposals to perfect the problem of unfair competition in the bidding ranking.First,it provides suggestions for improvement from the legislative level,which mainly aims at the current Anti-Unfair Competition Law.Secondly,it provides suggestions for improvement from the judicial aspect,aiming at provide recommendation mainly for various service providers and advertisers who are involved in unfair competition of online bidding rankings.The third is about the suggestions from administrative level,which mainly involves the management of the bidding platform by relevant authorities.In the end,it is also a proposal that the author considers to be very important,mainly about self-regulation and supervision came from users.All walks of life should normalize online market behavior properly while regulating the behavior of offline market behavior.Simultaneously,the supervision of the extensive Internet users is the most effective and best way to directly reflect the problems and cure the problems radically.
