Research On Legal Issues Of Safety Supervision Of Private Kindergartens In My Country

Preschool education,as the first step of children's education,is of great important.Preschool education not only pays attention to the cultivation of children's intelligence and personality,but also lays a good foundation for their future education.At present,the preschool education industry in China is mainly composed of public kindergartens,private kindergartens and universally beneficial kindergartens,well competitive environment among which will promote the healthy development of the whole industry.Though the education quality of public kindergartens is higher,their amount is limited,which can not meet the meet the public demand.The appearance of private kindergartens eased the pressure of public demand to some extent,and provided another choices for the public.Due to the uneven education qualities as well as the frequently occurred safety accidents in private kindergartens make the public worried.Since 2017,more than 20 cases of child abuse have been reported,school building and food safety accidents also occurred frequently,most of which happened in private kindergartens.As the most basic guarantee of preschool education,personal security should be paid more attention to.Therefore,to improve the safety supervision and promote the healthy development of private kindergartens,this study mainly discusses the current development of private kindergartens and the problems of safety regulation from the following four aspects.The first chapter mainly introduced the current running situation of private kindergartens,analyzed its development trend,and discussed the meaning of their existence.In addition,by combining the typical case,it is recognized that many safety problems are still existed in private kindergartens.By comparing the legal character and safety regulation of private kindergartens with public kindergartens,this paper summarized the particularity of the legal character of private kindergartens and the impact of making private kindergartens as legal persons on their safety regulation.In the second chapter and the third chapter is the key chapter of this paper.According to the different stages of the administrative supervision process,the author discussed the legal problems in the actual supervision process of private kindergartens,which can be divided into the following two stages: proactive regulation and post-event regulation.First,China's relevant legal system of supervision in advance can not keep up with the needs of the actual development.Second,the absence of preschool education law,unreasonable local level supervision system involving private kindergartens,unreasonable admission system of preschool teachers,unreasonable admission system of private kindergartens and exit system all reflect the weak legal basis of the government for the safety supervision of private kindergartens.In addition,the paper points out the deficiencies in the current situation of supervision.By analyzing the region with frequent occurrence cases,this paper summarized the advantages and disadvantages of regulatory in this areas,and analyzed whether it can be applied to other areas.Through the analysis and summary of these data,it can be concluded that the current supervision of private kindergartens is insufficient.In the third chapter of this paper,the author collected and processed the relevant data of litigation cases involving private kindergartens from 2015 to 2019.Through these data,the author analyze the annual trend of the total number of cases and the proportion of various cases according to their characteristics,and thus summarized the reasons for the phenomenon.First,the author summarized the legal problems existing in this stage of regulation.Second,in the post-event regulation stage,this paper points out the legal problems related to the information disclosure mechanism of private kindergartens,the lack of relevant social supervision,and discussed the legal problems in the comprehensive law enforcement mechanism between government administrative departments.The last chapter of this article will summarize and put forward relevant suggestions according to the legal issues raised above.This chapter is still classified and discussed according to different stages in the supervision process.In the stage of supervision in advance,the author suggested to promote the process of special legislation of preschool education,improve the access system and exit system of private kindergartens,and consolidate the market order of private kindergartens.In addition,the government should strictly enforce the admission system of preschool teachers,build a new audit mechanism,improve audit efficiency,and promote the overall qualification level of preschool teachers;in the proactive regulation stage,the author suggested that the government should speed up the clarification of the responsibilities of various administrative departments,strengthen the communication of information resources among departments,and strictly pursue the legal responsibilities of corresponding individuals;in the post-event regulation stage,the government should promote private kindergartens to improve the information disclosure mechanism,we should set up a diversified information disclosure platform,expand the scope of information disclosure,and pay attention to the timeliness of information disclosure.At the same time,improve the regulation mechanism of social organizations for private kindergarten industry is also needed.
