Research On Government Regulation Of Private Pension Institutions In China

Private pension institutions refers to the citizens,legal persons and other organization shall,for the elderly living,life care,rehabilitation nursing services such as pension institutions.Private pension institutions as the main market with asymmetric information,exteenality,congenital defects such as heavy light fair efficiency,market spontaneous,adjustment is inevitable,the government as the principal part of market activity of adjustment has the advantages of equity,mandatory for the standardization of the marketing activities of private pension institutions,safeguard market order has important significance of health,from the aspects of classification regulation means,the government's regulation of private pension institutions including economic regulation and social regulation and administrative regulation.This article selects lushan county of Henan province to heavy Eden health elderly apartment fire as a case to the development of private pension institutions and government regulation is analyzed,in May 2015 Eden health elderly apartment house built for use is not in conformity with the provisions of the state of the flammable materials of important fire,killing 39 old man on the spot,6 people were injured,direct economic loss of 20.645 million yuan,which reflects the private pension institutions in China and the regulation of a series of problems,unreasonable economic regulating private pension institutions in terms of pricing,the government public pension institutions and private pension institutions to adopt different regulation and policy,cause unfair competition environment,private pension institutions may adopt the method of reduce the quality of service to compress costs,for private pension institutions in the pension industry development is adverse,market access and exit is not standard,illegal operation.The quality standard of the social regulation is not clear,the evaluation standard is not specific,and the safety consciousness of the supervisor is absent;Administrative regulation on regulation subject responsibility divided not clear,long regulation,scope of right cross,some legal norms is relatively general,lack of maneuverability,the government resulted from regulatory capture.After clarifying the problems and causes of the government-regulated private pension institutions,the author tentatively put forward the countermeasures and suggestions to improve the government regulation.Among them,economic regulation mainly relates to the market access,exit and price regulation of private pension institutions and the economic problems related to market competition;Social regulation includes setting clear quality standards,evaluation criteria and strengthening safety supervision.The improvement of government administrative regulation depends mainly on the transformation of government functions.It should also improve the regulation law,avoid the capture of regulation,strengthen the supervision of the regulators,and strengthen the implementation effect of the regulations and policies.
