In the rapid development of science and technology today,"the people's growing spiritual and cultural needs" was seriously rise gradually,short video industry in China since the 4 g network popularization and then realize the high speed development,and the rise of the trill,the scale of hundreds of millions of users short video platforms such as quickly in the age of the Internet has a great influence.The spread of COVID-19 in early 2020 allowed people across the country to spend more time at home,which led to a significant increase in the size and usage of online entertainment applications.As of December 2020,the number of netizens in China has reached 989 million,the number of online video users has reached 927 million,and the number of short video users has reached 873 million,accounting for 88.3 percent of the total number of Internet users.Network video(including short video)has become the second largest type of Internet application after instant messaging.In the face of massive video materials,how to use copyright law to effectively protect the original content,how to solve the conflict between secondary creation and original creation,and how to judge the complicated and fair use problems in the network environment have been placed in front of the legal people.Based on the characteristics of short video different from traditional video industry,this paper classifies the object of the research,clarifies the definition,classification and characteristics of short video.Then it analyzes the originality of short video and the right limitation of short video copyright.The last part is the identification of short video copyright infringement.Finally,it comes to the conclusion that this paper discusses the infringement standards and identification of specific types of short video,which is helpful to solve the practical problems.
