Research On Duty Lawyer System In My Country

With the development of human rights,safeguarding the legitimate rights and interests of the accused has become a hot topic in practical research.The duty lawyer system has been piloted in China and gradually established its position in the Criminal Procedure Law,becoming a judicial system promoted nationwide.However,there are many problems and deficiencies in the lawyer's identity positioning,lawyers' participation enthusiasm,the granting of lawyers' litigation rights,and the management of lawyers' team,which hinder the development of the lawyer's system on duty in China.Therefore,it is necessary to study,summarize and improve the duty lawyer system in China,clarify the position of duty lawyers in China,position duty lawyers as defenders,increase the financial subsidies for duty lawyers,establish diversified financial subsidy channels,rationally plan and clearly grant litigation rights such as the right to meet,read papers and be present to duty lawyers in legislation,establish a mechanism for selecting,training and supervising duty lawyers,and truly play the role of duty lawyers system to effectively protect criminal suspects and defendants.
