In the full coverage of criminal defense and the promotion of trial-centered litigation system reform,in order to protect the lawful rights and interests of the prosecuted,the system of on-duty lawyers has developed rapidly.Normally,legal aid lawyers can only help specific criminals.On the other hand,the duty lawyer has no restrictions on the object of providing legal assistance.The duty lawyer system expands the scope of benefits of legal aid,and better exerts the positive role of legal aid.After years of continuous exploration,my country's on-duty lawyer system has basically taken shape,and it has played an important role in leniency system of guilty plea and criminal speedy trial procedure.The current research on duty lawyers in my country is mainly focused on the operation of the duty lawyer system,but insufficient attention is paid to the litigation rights of duty lawyers.If duty lawyers lack litigation rights,they cannot better help defendants defend their rights.By discussing the basic rights of on-duty lawyers such as the right to presence,right to review files,and the right to defend,as the most basic rights of on-duty lawyers,the full use of these rights is crucial to the development of on-duty lawyers.
