On The Application Of Small Claims Procedure In My Country

With the increasing number of civil and commercial dispute cases accepted by the people's court,the existing judicial resources are gradually unable to meet the judicial needs of the society.In order to resolve the increasing economic disputes,reduce the litigation burden of the parties,and solve the extrusive contradiction under more cases and fewer people,the NPC Standing Committee added small claims to the chapter of summary procedure when amending the law of civil dispute in 2012,but the item is too simple.In2015,the Supreme People's court used a separate chapter to refine small claims in the interpretation of the application of the Civil Dispute Law of PRC.However,about small claims,in the specific practice process,its effect is not ideal.This article intends to analyze the existing problems in the practice of small claims through the data analysis in our country,deeply analyzes the causes of the problems.Also,to come up with a few suggestions on how to improve the small claims procedure combined with the profitable experience of foreign countries.
