Research On The Qualifications Of Plaintiffs In Administrative Public Interest Litigation In My Country

Under the background of China's continuous economic and social development,public interest protection has become the key issue of increasing social concern.Once the administrative organs cannot timely perform their duties in accordance with the law,the public interests will be damaged.Administrative public interest litigation is based on the litigation system generated by urging administrative organs to timely fulfill the need to safeguard the national public interests in accordance with the law.The emergence of litigation activities is based on the plaintiff's prosecution,which leads to the court's trial investigation procedure and the defendant's defense activities.In the legal relationship of administrative public interest litigation,which legal subjects can bring administrative public interest litigation and have the qualification of plaintiff is an important prerequisite for the reasonable and effective operation of the administrative public interest litigation system.The establishment of the correct scope of the plaintiff's qualification for administrative public interest litigation is of both theoretical and practical significance.It is not only an important exploration of the current theory of administrative public interest litigation,but also helps to supplement and perfect the administrative public interest litigation system.Based on this,this paper,on the basis of a preliminary introduction to the concept and theory of the plaintiff's qualification for administrative public interest litigation,combined with the case of judicial practice,analyzes the system design and existing problems of the plaintiff's qualification for administrative public interest litigation in China,and compares it with the system of foreign countries such as the United States,It is stipulated that social organizations and individual citizens can obtain the plaintiff qualification of administrative public interest litigation,so as to protect social public welfare and avoid the waste of judicial resources.
