Research On The Publicity System Of Administrative Law Enforcement

In 2019,the General Office of the State Council issued the Guiding Opinions on Comprehensively Implementing the System of Publicity of Administrative Law Enforcement,Record System of the Whole Process of Law Enforcement,Legal Review System of Major Law Enforcement Decisions,hereinafter referred to as the Guiding Opinions,marking the official establishment of the system of publicity of administrative law enforcement in China.As a new administrative system,this system has experienced several years of development and achieved preliminary results from pilot to comprehensive implementation,but there are still many shortcomings in many aspects.For example,the subject of publicity is not clear,the program of publicity is not perfect and the lack of effective supervision and relief.This paper is divided into four parts to study the public notice system of administrative law enforcement in China,trying to explore the system from multiple angles,find out its shortcomings and put forward suggestions to improve it,so as to provide reference for the legislation and law enforcement of the public notice system of administrative law enforcement in China.The first part is a systematic elaboration of the basic theory of the administrative law enforcement publicity system.The second part is to analyze the present situation and existing problems of the administrative law enforcement publicity system in China.The third part is to analyze the development of foreign administrative law enforcement publicity system and its reference significance to our country.The fourth part puts forward some suggestions to improve the administrative law enforcement publicity system,such as clarifying the main body,scope and procedure of the system,as well as improving the supervision and relief of the system,hoping to provide certain theoretical support and reasonable suggestions for improving the administrative law enforcement publicity system in China.
