A Qualitative Study On Drug Purchasing Behavior

Drug crime has always been the focus of national prevention and crackdown.With the change of drug trading forms,the act of purchasing drugs on behalf of others was first put forward.Due to the complexity of the form of the act of purchasing drugs on behalf of others,the types of acts vary greatly.In judicial practice,there are disputes on the specific applicable charges of the courts in such cases.Recently,the normative legal documents related to drug-related crime cases can be seen in FS [2016] No.8published in April 2016.It is a pity that the nature of drug purchasing and related issues have not been involved.Due to the lack of legislation and judicial practice,China only weakly responds to the qualitative demand of drug purchasing agency by printing and distributing meeting minutes.However,the provisions of meeting minutes are not perfect,and there are some viewpoints in academic circles,such as the crime of drug trafficking and the crime of illegal possession of drugs,which hinder the normal play of criminal law in drug purchasing agency cases.Based on this,this paper studies the qualitative problem of drug purchasing agency,To build a reasonable foundation for the criminalization of drug purchasing on behalf of others.This paper first puts forward the case,analyzes the charges of drug purchasing agent in different situations,summarizes the contents related to drug purchasing behavior in the case,summarizes the controversial focus of the case,and finds out the crux of the problem.Secondly,it explains the basic concept and classification of drug purchasing behavior.Drug purchasing behavior is a behavior system.According to the different behavior patterns and behavior types,it discusses and reasonably distinguishes the drug purchasing behaviors that may constitute different crimes,so as to provide guidance for its qualitative research.Thirdly,it mainly sorts out the theoretical contentions about the focus of controversy of the current scholars in the field of criminal law,reflects on the existing research path and makes evaluation.Finally,from the clear criteria of the crime of drug trafficking and the crime of illegal possession of drugs as well as their specific application,qualitative suggestions are put forward for drug purchasing.
