On The Procuratorial Supervision Of Civil False Lawsuits

False litigation refers to the action that the parties bring a civil action to make the court make a wrong judgment by forging facts and evidence for illegal purposes.In recent years,false lawsuits have occurred frequently,harming the interests of others,as well as undermining the credibility of the judiciary.Article 134 of the Constitution provides that the Public Prosecutor's Office is the country's legal oversight authority.In response to false litigation,prosecutors must take full advantage of the role of oversight of the public prosecutor,using its powers to identify,investigate and verify false disputes,then take action against false disputes and protect the judicial authority.The article analyzes the basic theory of public prosecution oversight of civil falsehoods,sets out the proper basis for the prosecutor's supervision over fake litigation,and it is necessary and feasible for the prosecutor's office to intervene in bogus litigation.The article analyzes the current practice of prosecutors intervening in false claims.The article analyzes the difficulties of procurators involved in false litigation from three perspectives: the difficulty of finding clues in supervision,the difficulty of an investigation and review by the prosecutor,and the difficulty of overseeing a false mediation.It combines the status quo of legal practice and puts forward specific suggestions to improve the procuratorate's supervision of false lawsuits.
