With the continuous development of network information technology,the Internet has become a "virtual society" separated from reality.With its unique information coverage and unparalleled speed of communication,it has profoundly changed the human society.But what follows is that the network is full of more and more rumors,this network chronic disease is in urgent need of rectification.Network disinformation behavior not only destroys the healthy network environment,but also imperceptibly disturbs people's thought,psychology and behavior,more seriously,it causes social shock,endangers public safety and damages public interests.In recent years,although some Internet users have been punished for their disinformation on the Internet,and Internet users have gradually paid attention to their words and deeds,some problems have not been completely solved.This paper takes Loudi Xiao of Hunan Province as the starting point,Aba Yangmou slander traffic police case,Sichuan Lixian Jiangmou deliberately fabricate,spread false kill student case as the starting point,leads to the following focus questions :1,what is the network rumor regulated by criminal law;2,whether the public place contains the network space;3,whether the standard of admission is single and vague;4,what should be the crime of network disinformation;5,whether the criminal responsibility is too light.After analyzing the focus of the problem,aiming at the current problems of the criminal law regulation of network rumors,combined with the foreign governance experience,put forward the corresponding perfect suggestions,so as to make the regulation of network rumour behavior more standardized and rationalized.In judicial practice,we can have laws to abide by and adapt to crime.
