Research On The Crime Of Juvenile Homicide In The Qing Dynasty

Intentional homicide is an infringement of human rights and interests.In ancient China,although there were no concepts of personal rights and interests,equal treatment and so on,the rulers of all dynasties attached great importance to intentional homicide.This is because of the particularity of human life cases,if not paid attention to,will eventually affect the entire social order and the rights and interests of the rulers themselves.As the main body of homicide,minors,because of their young age,often consider the principle of "caring for the young" embodied in the traditional law in the trial,and inevitably take into account the reasonable factors in sentencing.Therefore,the ruler attached great importance to strive to stabilize the foundation of dynasty rule.The Qing Dynasty was the last period of feudal society in the history of our country,and the development of feudal society was approaching maturity.At the same time,the historical data left over from the Qing Dynasty about juvenile homicide is particularly rich,which is of typical significance for the study of juvenile homicide.The author analyzes the constitution,causes and characteristics of juvenile homicide from a large number of cases of juvenile homicide recorded in Qing Dynasty historical data"Summary of Criminal Cases(Part 3)" Refutation Collection" and "Historical Jurisprudence of successive dynasties ",and selects the representative and instructive Ding Qi Sanzi case and Liu Mi Zi case to analyze the different regulations and guiding ideology behind different trials.The rulers of Qing Dynasty basically followed the principle of" caring for the young "embodied in the" Qing Law "and also included the special provisions of" holy meaning is law "in the Qing Dynasty.In view of this,the author expounds the combination of emperor,official,statute and reason.Through the review of history,we hope to provide corresponding reference for the current management of juvenile homicide in China.
