On The Change Of The Reorganization Plan

Reorganization plan can determine whether the bankruptcy reorganization procedure are made.The reorganization plan should be allowed to change when it is hard to be continued or there is a better plan during the implementation process.Nowadays,this part has not been specified in China’s "enterprise bankrupt law",which is only partially explained by "national court bankruptcy trial minutes".The system of reorganization plan in general needs to be improved.Starting with the connotation and basic principles of reorganization plan,this thesis studied the substantive requirements for the change of reorganization plan through analyzing changeable subjects,conditions and contents respectively.Furthermore,with the combination of current situation in foreign legislation and the actual situation of China,this thesis discusses the voting,approval and the effect of the alter in the process of reorganization plan change for a reasonable reorganization plan change system.
