Add A Study On The Crime Of Manipulating Sports Competitions

Since the third meeting of the 13th National People's Congress of my country and the third meeting of the 13th National Committee of the Chinese People's Political Consultative Conference,the "new era of fairness and justice" has become a new benchmark for the construction of the rule of law in China.Complementing it is the passage and implementation of the "Criminal Law Amendment(11)." With the development and update of the country's economic and cultural situation,my country's "Criminal Law" is also advancing with the times.In the"Criminal Law Amendment(11)",the crime of throwing objects at height,the crime of obstructing safe driving,and the crime of impostering have been added.They are all efforts made by my country's "Criminal Law" to adapt to the progress of the times,economic development,and adjustments to new areas and new issues.However,competitive sports has become a cultural field that has become more and more popular among the people in recent years.However,there are still many legislative loopholes in the regulation of the "Criminal Law",especially the comprehensive criminal law evaluation of the manipulation of sports competitions.Judging from the judicial practice of our country,the crime of manipulating sports games is basically evaluated as the crime of bribery by non-state personnel.In most countries abroad,it is also evaluated as crimes such as bribery,fraud,and gambling.It can be found after analysis of relevant cases that the manipulation of sports games cannot only be evaluated by bribery,fraud,gambling,etc.,but also covers other forms of behavior,and should be subject to a separate legal evaluation.For example,referees blow "black whistle" after accepting bribes,sports officials illegally give participants qualifications,falsely report player information,betting companies manipulate the outcome of matches,club leaders or sports team coaches instruct players to "fight fake matches",etc.When these acts of manipulating sports competitions exceed the limits of the "Sports Law" regulation and rise to the level of crimes,the only provisions in the "Sports Law" that are related to the"Criminal Law" Article 51 are not sufficient to deal with Manipulate sports competitions to conduct comprehensive criminal law evaluation and regulation.This article discusses and proposes to add the crime of game manipulation to achieve the criminal regulation of such illegal acts,thereby establishing the "last line of defense" for the development of the competitive sports industry,in order to achieve fairness and justice,and promote the goal of comprehensive construction of the rule of law in our country.First,it explains the criminal field,definition,and behavioral manifestations of game manipulation.Secondly,it explains the necessity and importance of constructing the crime of manipulating sports games in our country.Manipulating sports games has serious social harm.Adding the crime of manipulating sports games will help.Fill in the legal loopholes in our country,meet the requirements of the number of crimes,and realize the adaptation of the perpetrator's guilt,responsibility and punishment;then learn from the successful experience of foreign sports developed countries in legal regulation of this type of game manipulation behavior,and conclude that it is suitable for my country's criminal law in the field of competitive sports The measures that should be taken to make legislative recommendations.Finally,it is the core of this article.It proposes the addition of criminal legislation for the crime of manipulating sports games.It believes that the practice of manipulating sports games in the field of competitive sports has serious social harm.It also elaborates on the elements of crimes,judicial identification and penal application,etc.The current situation of my country's competitive sports development and the principle of comprehensive rule of law require my country to add new charges in the field of competitive sports,which is of great significance.
