| The development of social economy promotes the development of online game live broadcasting industry,and online game live broadcasting is more and more entering the public life.However,while new things develop vigorously,corresponding legal problems will arise.In recent years,online game live broadcasting,operator's piracy behavior has occurred from time to time,but due to the current anti-unfair competition law,there are many deficiencies in the regulation of this behavior,such as protection effectiveness,responsibility and so on,the rights and interests of online game live broadcasting operators and consumers can not be effectively protected.How to improve the Anti-unfair Competition Law of operator's piracy behavior in online game live broadcasting has become an urgent problem to be solved.Therefore,the article mainly takes the anti-unfair competition law regulation of operator's piracy behavior in online game live broadcasting as the research object,and intends to adopt the literature research method,case analysis method and comparative analysis method.Through the analysis of the concept,characteristics and the current situation of operator's piracy behavior in online game live broadcasting,the article points out the deficiencies of regulation and puts forward some suggestions for improvement.?Apart from the introduction and conclusion,the article is divided into five parts:Part ?: Typical cases and reflections.The article begins with a brief summary of the classical cases closely related to the topic,and then puts forward the research object of this paper through the analysis of the main points of judgement and case thinking,that is,the anti-unfair competition law regulation of operator's piracy behavior in online game live broadcasting.Part ?: Overview of operator's piracy behavior in online game live broadcasting.Firstly,the article defines the concept of operator's piracy behavior in online game live broadcasting and analyses its specific characteristics;secondly,it fully analyses the two different understandings of academic and judicial circles on this behavior;finally,the article defines this behavior as unfair competition regulated by Article 2 of the Anti-Unfair Competition Law combined with various theories and viewpoints.Part ?: The current situation and dilemma of competition law regulation on operator's piracy behavior in online game live broadcasting in China.Based on the current situation of legislation and judicial practice of anti-unfair competition law,this paper points out that there are many deficiencies in the regulation of operator's piracy behavior in online game live broadcasting in China,such as low protection effectiveness and incomplete determination parameters of compensation amount.Part ?: The necessity of perfecting the competition law regulation of operator's piracy behavior in online game live broadcasting.This paper discusses the necessity of perfecting the regulation of anti-unfair competition law for operator's piracy behavior in online game live broadcasting from three aspects: strengthening the regulation function of anti-unfair competition law,protecting the legitimate rights and interests of operators and consumers of online game live broadcasting,and strengthening the maintenance of competition order in the field of online game live broadcasting.The fifth part: Suggestions on perfecting the regulation of operator's piracy behavior in online game live broadcasting in China by competition law.On the basis of combining theory with judicial practice,aiming at the lack of regulation mentioned above,the article puts forward several suggestions,such as strengthening the protection of anti-unfair competition law in the field of online game live broadcasting,breaking through the uncertainty of determining unfair competition behavior,considering the determination parameters of compensation amount and perfecting relevant supporting legal documents,and attaching importance to relevant supporting supervision and management mechanisms. |
