| The combination of artificial intelligence technology and the field of news production has brought tremendous changes to the news industry.Compared with the traditional news production mode,the application of smart news has obvious advantages in obtaining news sources,manuscript production,writing mode,and distribution channels.Intelligent news is generated based on algorithm programs,and can be divided into filling news,extractive news and automatically generated news.At present,smart news is mainly used in news that is characterized by automatic generation of text in a structured format and existing data information,such as financial news,weather news,sports news and other fields.The development trend of smart news is in full swing.On the one hand,the combination of journalism and artificial intelligence technology has brought the news industry into a new era;on the other hand,the copyright issue of smart news has also become prominent.At this stage,artificial intelligence technology is rapidly developing from weak artificial intelligence to strong artificial intelligence.At this stage,intelligent news has met all the requirements of the copyright law except for natural persons.It is foreseeable that in the near future,it will no longer be a fantasy for smart news to meet the requirements of originality.Therefore,it is of great significance to discuss whether smart news constitutes a work and its protection mode.Based on this,this research explores the production process of smart news,analyzes and confirms the copyright ownership of some smart news,in order to further protect and standardize the smart news market,protect the rights and interests of smart news owners,and make the smart news industry enter a virtuous circle.For the smart news of the work,the producer should be classified as the actual owner of the smart news copyright,and the user shall be the qualified owner.Smart news that does not constitute news works should be protected with neighboring rights.At the same time,the copyright law should be adjusted to allow the transfer of personal rights of copyrights under certain circumstances.Regarding the revision of copyright,this article believes that the definition of the work should be clarified first;secondly,the expression of ideas in originality should be emphasized.Finally,the neighboring rights of news publishers should be established as soon as possible,punitive damages should be increased,illegal costs should be increased,and the rights and interests of smart news owners should be protected. |
