Research On The Causes And Resolution Strategies Of News Copyright Disputes Under The Background Of New Technology

Since its birth,copyright contains the dual value attributes of natural rights and instrumentalism,which is closely related to the development of media technology.With the development of mobile Internet,new media forms emerge in endlessly,breaking the balance of interests among content producers,communicators and users,challenging the existing news copyright protection mechanism in China,and the news copyright disputes show new characteristics:the subjects of disputes are more diversified,and the focus is on the aggregate media;unauthorized reprint and deep link become the current news In the face of copyright infringement;most of the news media defend their rights in the way of public opinion debate,and a few adopt the way of litigation.Based on the analysis of a large number of cases of news copyright disputes,this paper analyzes the causes of news copyright disputes under the background of new technology from three aspects of values,system and economy,and holds that the conflict between the old and new media is essentially the conflict between the traditional copyright concept and the Internet value logic,and the traditional media adhere to the traditional copyright theory of "creating for profit",the value logic of new aggregate media based on Internet intercommunication and sharing calls for the emergence of a new concept of copyright.This conflict of value logic makes it difficult to reconcile the copyright conflicts between new and old media.At the same time of the frequent and more complex copyright disputes between news media,the traditional copyright system in China has many defects and lags,and the inability to deal with the system to a certain extent aggravates the occurrence of copyright disputes in news media.But it is the imbalance of interest distribution between news media.On the one hand,"zero time difference reprint" makes the input of content production directly proportional to the return difficult;on the other hand,the profit model of"second sale" of traditional media has been impacted,and no new profit model has been exploredSimilar to the situation in China,the United States and the European Union also face the issue of copyright disputes in news media.The third chapter examines the "hot news abuse rules"of the United States and the reform of the new EU copyright law,and draws two useful inspirations:to solve the copyright problem through competition law and non copyright solution;and to focus on the demand side and promote the digital transformation of traditional media Finally,based on the current situation of copyright disputes in China's news media,this paper draws on the solutions of copyright disputes in Europe and the United States,and concludes the feasible ways to resolve copyright disputes in China's news media from three aspects:from the perspective of the media,the media itself should improve its own protection procedures and accelerate the digital transformation;from the perspective of the industry,the new and old media should strengthen the depth of content and channels From the national level,the state should not only optimize the design of copyright rules,but also focus on the user demand side,guide and promote the transformation and upgrading of the industry.
