In traditional administrative assistance theory and practice,the subject of administrative assistance is mostly the assistance between administrative agencies and the assistance of citizens as administrative counterparts.In the context of a risky society such as the outbreak of Noval coronavirus,more and more citizens are participating in administrative procedures as subjects,such as participating in epidemic prevention and control work as volunteers at the request of administrative agencies,and participating in administrative agencies.Organized public security patrols,etc.At present,there is very little research on the theory of citizens'administrative assistance in our country,and there are no clear regulations on citizens'administrative assistance in the law,and the legal regulations on the voluntary provision of administrative assistance by citizens upon the request of administrative agencies are almost blank.Therefore,the research on the legal issues of citizen administrative assistance has high theoretical and practical value.From the perspective of responding to actual needs,this article analyzes the connotation and extension of citizen administrative assistance,and believes that citizen administrative assistance must be related to public interests,and citizen assistance behavior is not only an obligation,but also the right.This thesis also analyzes the practical problems of administrative assistance,and elaborates on the basic status quo of the administrative legal system,the problems existing in the administrative assistance legal system and the problems in the operation of the system.The research on the theory of administrative assistance to citizens is inseparable from the comparative study of the rule of law outside the territory.This article selects the administrative assistance systems of Germany,Spain and the Common Law system countries for comparative research,and draws on the advanced legislative experience and theoretical research of these countries.This article believes that to build a complete legal system for citizens' administrative assistance,it is necessary to take legal assistance as the basic principle of the system,and to clarify the scope of statutory matters for citizens5 administrative assistance through the law;The principle of efficiency is the basic principle of administrative management,and it is also the need for administrative agencies to request citizens for administrative assistance.In order to improve efficiency,we need to build efficient procedures to ensure that administrative assistance is carried out in accordance with the law;in order to achieve the ideal state of administrative assistance for citizens,we also have It is necessary to scientifically set the scope of subjects based on the principle of maximizing benefits.
