Research On The Administrative Assistance System Of China

With the fast development of socialist market economy,the legal consciousness of citizens is being raised gradually,only administrative agency improve the ability of administration constantly can better adapt to the social development.The social division of labor go into more and more professional,makes administrative agency be not competent enough to deal with the complicated social affairs independently. Faced with this awkward dilemma,there is administrative assistance system.Administrative assistance system generally refers to more than two administrative agency complete administrative management goal as a way of helping each other. This process occurs in the the process of exercising the right of administration,and the multiple administrative body is not superior-inferior relationship.Cause of the mutual assistance is legal reason or the factual reason. Administrative assistance system related to the two parties,one party is requested principal, the other party is the main body of the requested.In a nutshell,administrative assistance system is a mutually beneficial relationship of the two parties.Efficient administrative organization should be a pattern of a whole of aspire after balanced and integrate. In the larger sense,our country’s existing administrative hierarchy system,makes the administrative system exist as a whole in a harmonious state,The relationship between the administrative body.If we want to make the relationship between administrative organization become more harmonious in detail,we must need the administrative assistance system.From the perspective of the content, the scope for exercising authority of administrative organs involve all professions and trades,such as the areas of economy, finance, education, science, culture, health, sports, environmental and resources protection, urban and rural construction.The research focus of the traditional administrative law are being on the specific administrative act which keep close ties with administrative counterpart generally.There is no denying that research of the law of administrative procedure noticeably lag behind substantive administrative law.The research on administrative assistance is less and less.It has very important theoretical and practical significance of the system of administrative assistance.The nature of administrative assistance system is make government agency cooperate more closely,learn from others’ strong points and close the gap on the basis of common administrative purposes.The system of administrative assistance is a powerful tool for safeguard human rights and interests of the executive relative and administrative agencies exercise the administrative power better.This paper will use four chapters to introduce the system of administrative assistance.In the first chapter,i will describes the basic theoretical issues of administrative assistance.The first chapter mainly include the concept of administrative assistance,the basic classification,the theoretical basis of the system of administrative assistance and discusses the necessity of establishing the system of administrative assistance.In the second chapter,i will discuss the current situation of our country’s administrative assistance from two aspects--current situation of legislation and how it works in practice.The research purpose of this chapter is to get problems and insufficiency of the system of administrative assistance of our country. The third chapter discusses overseas administration assistance system,the purpose is to summarize the advantages and strengths.This chapter mainly studies relative mature administration assistance system of Germany, Japan, South Korea, Spain, Taiwan of China.The last chapter will put forward the opinions to perfect our country’s administrative assistance system from the basic principles to specific program.
