Research On The Attributes Of Credit Administrative Evaluation And Its Legal Regulation

It is an important social issue to build a new regulatory mechanism with social credit as the starting point.Based on the background that word-of-mouth credit evaluation can not meet the development needs of non acquaintance society,the public urgently calls for more credible and influential credit administrative evaluation.In the process of social credit system construction,credit administrative evaluation has become a widely used means of relevant administrative evaluation subjects.However,due to the lack of the basic law of credit,the understanding of the attributes of credit administrative evaluation is diversified.It is necessary to make a theoretical definition of the attributes of credit administrative evaluation.From the perspective of practice,credit administrative evaluation is widespread,but in some legal provisions and normative documents,it still faces all kinds of questions to be answered.Based on the regional differences in the practice of legislation and law enforcement of credit administrative evaluation,there are some problems in the current credit administrative evaluation system,such as insufficient supply of legislation,different evaluation standards,lack of operational guidance,lack of information sharing and relief mechanism,which constitute the tension between legitimacy and practical effectiveness.It is necessary to reshape the credit administrative evaluation system from the system.First of all,we should follow the government's limited supervision,explore the specific ideas of system remodeling from the two levels of legitimacy and practical effectiveness,and review the constitutionality,legitimacy and rationality of the authorization and specific provisions of relevant evaluation departments.Secondly,in terms of procedure operation,we should improve the procedure of making relevant norms and the execution procedure of evaluation behavior,and ensure that the right relief channel of the relative person is unblocked by dynamically adjusting the procedure.Finally,by setting the route,content and intensity of judicial review,and by maintaining the last line of defense of fairness and justice,we should guard against the expansion and abuse of the power of credit administrative evaluation,strive to make the credit administrative evaluation system develop in a benign direction,and create a social governance pattern of co construction,CO governance and sharing.
