Investigation Report On Legal Issues Concerning Protection Of Landless Farmers' Rights And Interests In Zhongshan District, Liupanshui City

The report of the 19 th National Congress of the Communist Party of China clearly put forward the implementation of rural revitalization strategy.The implementation of the rural revitalization strategy can promote the development of emerging industries in rural areas.At the same time,it is urgent to strengthen rural infrastructure construction.In order to meet the growing needs of farmers for life,culture,medical treatment and entertainment,the construction of rural libraries,cultural organizations,medical and health facilities,fitness venues,supermarkets,kindergartens and nurseries,household waste and sewage treatment and other infrastructure will be involved,with a large area and a wide range of land needs.As a vulnerable group,land-lost farmers have suffered serious losses in the process of farmland expropriation,and the disputes caused by farmland expropriation are increasing day by day.Therefore,it is urgent and realistic to study the protection of land-lost farmers' rights and interests in Zhongshan District of Liupanshui City.This article selects Zhongshan District of Liupanshui City of the collection of instances of three important projects within their respective jurisdictions,survey to collect data,the basic situation of the landless farmers and related rights protection present situation,the tools of literature consultation,social research and paired comparison,the combination of qualitative and quantitative methods,the analysis of research results will be informed of the farmers,the resettlement compensation right,employment rights and other rights associated with a damaged status display,data analysis,and summarize the existing in the process of resettlement compensation related legal issues,emphatically analyze the intrinsic reason of these questions.Based on the analysis of Zhongshan District of Liupanshui City based on the local actual situation of land expropriation,this article selects listed two other domestic cities of exploration and practice,the protection of the land-lost farmers rights and interests are Shenzhen,Changsha,to safeguard the rights and interests of land-lost farmers has taken good practice,summarized its worth Zhongshan District of Liupanshui City to learn from experience,and then a targeted in combination with the actual situation of Zhongshan District,puts forward five specific legal system in terms of thinking and the suggestion,in order to avoid in Zhongshan District rural revitalization of damage in the process of development of the landless farmers' legal rights and interests of the situation to happen again.The innovation of this study is as follows: First,from the perspective of developing rural revitalization,it systematically studies the rights and interests protection of land-lost farmers in the expropriation of agricultural land in Zhongshan District.Through the field investigation,this paper understands the current situation and causes of the damage to the rights and interests of the landless farmers in Zhongshan District,and then discusses the perfect measures theoretically,which provides a new idea for the comprehensive implementation of the rural revitalization strategy in Zhongshan District.Second,in the improvement measures,refer to the practical experience of other cities in China,put forward in line with the actual situation of Zhongshan District and has the feasibility of legal suggestions;Third,pay equal attention to the economic and non-economic legal interests protection of land-lost farmers,focus on protecting the interests of the majority of farmers,and help Zhongshan District achieve the goal of rural revitalization in an all-round way.
