Reforming Current Land Expropriation System And Protecting Farmer's Land Rights

Along with the continuous and quick development of Chinese economy and the gradual perfection of socialism market-oriented economic system, the current land expropriation system has not adapted well to this development and variety, the disadvantage and blemish of this system itself expose gradually, land illegal behavior becomes very seriously, and has been a threaten to Chinese urbanization progress, to farmer's legal rights, and even to the social stability. Therefore, the problem of land expropriation has become a source and a focus to " three agricultures" problem, and the reformation of current landexpropriation system is inevitable.The content of my thesis includes seven parts. Firstly, I overview the research conditions of the domestic and the international land expropriation system, and then clarify the main problems to be resolved and the theoretical and practical value which can be obtained by expectation of the reformation of China land expropriation system.Secondly, I review some foundational theories and basic concepts about land expropriation system in brief. In land property right theory, I introduce the concept and the characteristics of land expropriation power and the definition and the category of land expropriation compensation; In system theory, I introduce the concept , the category ,the change and the innovation of system in order to explain that the reformation of land expropriation system itself is a kind of activity of system innovation. All these foundational theories will offer an emollient basic for the studies and analyze below.Thirdly, in my own comprehension, I put forward the viewpoint that Chinese land expropriation system is divided into three periods according to the time of the creation and the modification of Land Expropriation System of the People's Republic of China, just as earlier period land expropriation system, near period land expropriation system...
