China's real estate economy has obviously gone through the honeymoon period of rapid development,followed by the stabilization and standardized development of China's real estate market.Compared with the blowout development of China's early real estate,some small and medium-sized local real estate development enterprises and even a few large-scale national real estate development enterprises are on the verge of bankruptcy and reorganization.The research objects of priority in the bankruptcy liquidation of real estate enterprises in the academic circle mostly focus on the protection of the rights and interests of the buyers and the intended guarantors.However,the research on the legal regulation of the Contractor's priority in the bankruptcy liquidation of real estate enterprises is not deep enough,most of which are the evaluation and improvement of the current legislative situation,and most of the suggestions are not targeted.The research object of this paper is mainly for residential real estate,commercial real estate as the main development object of the sale of commercial real estate enterprises.The author uses the method of empirical research and comparative analysis to collect experience,facts and judicial precedents through the network of judicial documents and the magic weapon of Peking University,analyzes and studies these judgment documents,combs the relevant laws and regulations of China's bankruptcy system,and compares it with the foreign bankruptcy system,so as to further combine with the current situation of China's judicial practice to provide reference for China In the bankruptcy liquidation of real estate enterprises,the legal regulation of the Contractor's priority and the judicial practice in specific cases are proposed.
