Research On The Types Of Crimes Involving Criminals By Public Officials

The development of mafia-related crimes in China is grim.Most mafia-related criminal organizations have the space to exist and develop and benefit from the "protection" of national public officials.It is important to explore the formation mechanism of mafia-related crimes of public officials for the punishment and prevention of crimes.The subject of mafia-related crime of public officials is diversified,and the behavior of public officials is varied,from obvious ways such as organization,leadership and participation to more covert ways such as cover up and connivance.Moreover,the reason for the crime is complicated,so this paper proposes a type method to study the mafia-related crime of public officials.Taking the judicial cases retrieved and screened in the "China Judicial Document Network" as the empirical research samples,this paper analyzes the characteristics of mafia-related crimes committed by public officials,and classifies the crimes committed by public officials into three types: covering up and conniving,organizing and leading,and participating in and helping.On the basis of the theory of crime micro generation patterns,Analyze the factors that cause crime,in combination with characteristics of various types of crime,and discusses the differences of the crime types generated factors and the crime types of generating mechanism of mode of civil servants of each type gang-related punishing and prevention countermeasures are put forward.This paper consists of four parts:The first part defines the relevant concepts,clarifies the scope of the subject studied in this paper,and defines public officials with the exercise of public power and performance of official duties as the core basis,which is consistent with the scope of public officials stipulated in the Supervision Law.Secondly,it is clear that the scope of mafia-related research in this paper refers to mafia-related organized crimes.Through the discrimination and analysis of the crime involving Mafia and the duty crime of the public officials,it is considered that the crime involving Mafia is only one of the forms of the crime involving Mafia.Finally,the necessity and value of the research on the type of mafia-related crimes of public officials are sorted out.The second part combines civil servants gang-related crime sample data,analyze the present situation of crime subject of crime presents the pluralistic,crime and varied characteristics,summarized on crime and to protect public servants gang-related crime into connivance,organization and leadership,to help three types,the comparative analysis of each type of crime.The third part analyzes the generating factors of mafia-related crime of public officials.Extend from characteristics to explore the reason,introducing the theory of crime chemical reaction equation of civil servants gang-related crime formation factors were analyzed,and the formation of the "individual study" comes from the extraordinary demand,the differences of extraordinary demand and environmental crime motive factors,thus the criminal personality formation,encounter power rent-seeking corruption bad lack of culture,religion and so on factor to sin,Crimes are "catalyzed" by the weakening of social control and the defects of legal system.Combined with the analysis of the generating factors of mafia-related crimes committed by public officials,it is found that each type of crime has different motives,and the "crime causing factors" and "catalyst" which act on each type of crime have different focuses,and the generating mechanism is different.The fourth part is based on our country's severe punishment strategy for the crime of mafia-related public officials,and puts forward the improvement of the judicial treatment of the crime of mafia-related public officials.We should attach importance to punishment and improve crime prevention measures at the same time,focusing on restraining the "crime causing factors" and "catalyst factors" of mafia-related crimes committed by public officials.To protect and connive mafia-related crimes,focus on the control of administrative and judicial discretion to improve the criminal law;On the one hand,it is necessary to strengthen the rule of law education for the grass-roots regime personnel and on the other hand,it is necessary to strictly control the election and supervision procedures.It is proposed to improve the information registration system of public officials and strictly enforce the law to block the opportunity of crime.
