Research On The Phenomenon Of Translation In Song Dynasty

In the long history of China,there seems to be no dynasty litigation atmosphere and people's rights can be as free and open as the Song Dynasty,the status of the people seems to be more equal than the past dynasties,the commodity economy is unprecedented active.The atmosphere of litigation has never flourished,people bravely break through the shackles and pursue rights and interests.This is manifested in litigation is the frequent occurrence of appeal activities.People's dissatisfaction with the outcome of the proceedings can be prosecuted all the time,in the "Ming Gong Shu Qing Ming Ji" called this phenomenon as a reversal of the lawsuit.Because of the lack of stability in the judgment,the result of the flood of litigation.The establishment of the government litigation system and the promulgation of a series of decrees are to make the rulers understand the grievances of the people,so as to carry out official inspection and power supervision,but it finally makes the litigation channel for the control of the people for health litigation.The appearance of a large number of appeals and health actions is considered to be an abuse of the litigation system.The cost of turning over the lawsuit is low.Because the officials have greater responsibility for the trial of the case,a little dissatisfaction will lead to endless turning over and heavy judicial responsibility,which makes the government hold a derogatory attitude towards such litigation behavior.Constantly limit the act of turning over.At the same time,the appellate litigation strategy will follow the policy changes,resulting in the government made various restrictions are not satisfactory.This phenomenon reflects the contradiction between maintaining political order and judicial security in the traditional man-run society,as well as the contradiction between judicial security and judicial justice,which reflects the differences of internal interests of the ruling class in the Song Dynasty.This paper attempts to explore the emergence of these phenomena and the value considerations behind them by studying the various aspects involved in the phenomenon,such as the parties in the judgment,the judicial officials' trial idea,the legal system and the Dahir involved in the prosecution,and then discusses the profound meaning.
