| In recent years,there has been a high incidence of individual crimes with the purpose of retaliating against the society.A series of social crimes of retaliating against non-specific objects by letting out the actor’s inner dissatisfaction have been frequently reported in the press.This kind of crime not only causes serious harm to the victim,but also impacts on the harmony and stability of the society,which has become a kind of crime problem concerned by all walks of life.This kind of crime is related to the construction of our socialist harmonious society and the promotion of people’s sense of security and happiness.This paper takes this kind of crime as the research object,and it has important theoretical and practical value to take the analysis of the cause of the crime as the main content of the research.By analyzing 135 case samples and combing the life experience and causes of the subject of the crime in the case,this paper holds that the perpetrator is often stimulated by some factors to commit the crime with the purpose of revenge on the society.Therefore,based on the stimulus factors that the subject of the crime received before committing the crime,This kind of crime can be divided into four types:cognitive distortion,disputes between officials and people,unsatisfactory work,and emotional frustration.The research idea of this paper is to analyze the individual cases and the overall cases of revenge social crimes,summarize the judicial status quo,characteristics and causes of such crimes,so as to get the countermeasures to prevent such crimes,in order to curb or reduce the occurrence of such crimes.The main characteristics of social revenge crime are that the subject of the crime is weak,the purpose of the crime is social,the object of the crime is not specific,and the way of the crime is extreme.On this basis,it is found that this kind of crime is the tension formed by the stimulation of external factors,and the tension breeds the result of the crime.This process is consistent with the "tension" caused by external factors and the criminal cause model with causal relationship between the crime.Therefore,this paper introduces the tension theory to theoretically analyze the causes of such crimes,and further analyzes the formation mechanism of such crimes on the basis of such factors as the maladjustment of social system structure,widespread social exclusion,pluralism of individual interest disputes and individual negative personality tendency.Through the analysis of the main characteristics and the mechanism of the crime,it is necessary to prevent this kind of crime from the root.For this kind of crime which seriously affects social security and stability,our country has always attached great importance to the punishment method of severe attack and heavy punishment and the prevention and control method of strengthening public security.However,there are still some problems in the related prevention and control work,such as the insufficient ability of early warning and prediction,the difficult effect of severe punishment afterwards,the bad operation of the relevant dispute resolution mechanism,and the rigid social support model,which promote the breeding of the actor’s revenge emotion.In view of these problems,this paper improves the prevention measures of such crimes from three aspects: pre-crime situation prevention,criminal response to crime and social policy prevention. |
