Investigation And Research On The Civil Case Registration System In My Country

In order to solve the problems of "difficulty in filing a case" and "difficulty in prosecution",China has implemented the reform of the civil case registration system.And the reform changed the form of filing a case to protect the litigant's right of litigation.Since 2015,the reform has been implemented for five years,many measures of local courts have been implemented and the reform has paid off.However,compared with the initial expectations of all sectors of society,it is still a big regret that the conditions for prosecution in the reform plan have not been substantially modified.In practice,while the current reform have made significant progress,it also faces a series of problems.So,in order to solve these problems,promote the reform of the registration system to better play its role,it is necessary to conduct a comprehensive review of current reforms.This article will be based on research,analyze the implementation status of the case registration system,and summarize its achievements and shortcomings,through comparative research,and puts forward targeted suggestions to improve my country's civil case registration system.This article is divided into four parts.The first part,through the investigation in the People's Court of Guanshanhu District,Guiyang City,review the current status of the reform of the civil case registration system,summarize progress and shortcomings.The second part,based on the problem,analyzes them causes,including:conflict between the conditions of prosecutionthe and litigation protection,improper functions of the case filing and trial courts because of authority,the imbalance between judicial needs and judicial resources,insufficient litigation screening functions related to case filing.The third part,by examining the civil case filing system of the civil law system and the common law system,summarize useful experience and gain enlightenmen.The fourth part,combined with our country's reality,put forward suggestions for improvement from four aspects,including: improve relevant laws and regulations,optimize the functions of the case filing and trial tribunals,optimize judicial resourcesm,improve the prevention and punishment mechanism against abuse of litigation rights,and hope to promote the modernization of our country's civil litigation system.
