Study Of The System Of Registration For Filing A Case In Civil Litigation

Filing a case is the first and most important link in the process of civil litigation.The procedure for filing a case directly symbolizes whether the setting up of channel for a civil case to get into a judicial process is reasonable or not.In April,2015,the Leading Group for Comprehensively Deepening Reform of the Central Government issued Opinions on the People's Court to Implement the Reform on the System of Registration for Filing a Case,which makes all-round stipulations as to the reform on the system of Registration for filing a case.On July 10,2015,the Supreme People's Court promulgated Several Stipulations on the Case Number of the People's Court and its companion standards.The establishment of the system of registration for filing a case in civil litigation means the process of the rule of law in China has stridden forward greatly.However,in the system of filing a case in China,it is provided that the substantive requirements should be checked in the stage of filing a case,which makes the procedural rights of the suitor cannot be guaranteed.Meanwhile,the system is lack of an effective mechanism for supervising the filing of cases and the suitor has difficulty in getting remedies when their legitimate rights and interests are damaged.Therefore,we also need to seek reasonable paths by making research into advanced mechanisms for filing a civil case of other countries so as to improve the system of accepting and hearing a case in China.
