Criminal Law Regulation Of School Violence

With the promotion of media reports and film and television works,the social harmfulness of campus violence cases has gradually attracted public attention.Nowadays,the problem of campus violence presents the development trend of group partnership,networking and younger age,which exposes the lack of effective regulation methods of travel.Therefore,we can consider using criminal law to regulate campus violence.Clarifying the concept of campus violence is the premise of criminal law regulation of campus violence.Starting with the concept of campus violence,this paper combs the development status of campus violence,so as to explore the deficiencies in China's legislation and judicial system in the process of legalization of campus violence.Based on the theory of crime,the age of criminal responsibility is too rigid;The lack of understanding of the types of violence in the law leads to a gap in criminal legislation.From the perspective of penalty theory,under the current legal system,a large number of accomplices of campus violent crimes escape criminal responsibility;For minors who have been subject to criminal punishment,the choice of punishment is single,resulting in the penalty execution process from the original living environment,which is very unfavorable to the physical and mental health growth of minors.In addition,this paper also introduces the methods of controlling campus violence crimes in other countries,and summarizes its advanced experience worthy of reference in the process of campus violence governance in our country.This paper explores the criminal legal solution to the crime of campus violence,so as to reduce the probability of campus violence cases.
