Research On The Countermeasures Of Preventing And Correcting Serious Violent Crime Committed By Minors

Recently,some achievements have been made in the prevention and control of juvenile crimes,and the overall situation of juvenile crimes has been improving,but serious violent crimes committed by minors are still not optimistic.Through empirical investigation,in recent years,the exposure frequency of serious violent crimes committed by minors with greater influence has increased,and they show the characteristics of younger age,adult-oriented means of committing crimes,and serious harm consequences,lack of necessary regulations and corrective measures for young minors who have not reached the age of criminal responsibility,arousing the attention and thinking of the society and academia.In addition to individual factors of minors,family upbringing,school education management,unhealthy culture,situational factors and factors of treatment all play a role in promoting serious violent crimes committed by minors.In response to the need for prevention and treatment of serious violent crimes committed by minors,the SPP accelerated exploration of a graded treatment system for minors,"Criminal Law Amendment(11)" lowers the minimum age of criminal responsibility to 12 years old with conditions.Moreover The Law on the Prevention of Minor’s Crime also improved remedial measures such as specialized education.While the country is actively exploring,it is more necessary to improve the countermeasures of serious violent crimes committed by minors from family,school,culture,situation and treatment.In this paper,through collecting 1024 cases of minors over the age of 14 from 2015 to 2020,as well as 58 typical cases of serious violent crimes committed by minors from media reports under 14 years old from 2011 to 2020,summed up the current general situation of serious violent crimes committed by minors in China and the characteristics,based on the analysis of the cause of the crime and some advanced experience at home and abroad,following the principle of two-way protection,the concept of early intervention runs through every link of the prevention and treatment of serious violent crimes committed by minors,and puts forward some suggestions to improve the practical work.The specific content includes the following five parts:The first part is the introduction.This part describes the research background,research significance,research status and research methods,laying a foundation for research ideas and follow-up discussionThe second part is an overview of serious violent crimes committed by minors.On the basis of clearly defining the related concepts of Juvenile crime and serious violent crime,combined with the research purpose,the concept of serious violent crime committed by minors is defined,and the research object and scope of this article are reasonably determined.The third part analyzes the current situation and characteristics of serious violent crimes committed by minors in our country.It mainly analyzes the current overall trend of serious violent crimes committed by minors in our country by browsing relevant documents,investigation reports,and collecting judgment cases and related media reports.Based on relevant statistical data,summarizes the types,subjects,behaviors,consequences and other characteristics of serious violent crimes committed by minors in my country.The fourth part analyzes the causes of serious violent crimes committed by minors in our country.The analysis of the causes of crimes is to better grasp the laws of certain types of crimes,so as to propose effective preventive and corrective measures.In-depth analysis of the causes of serious violent crimes committed by minors is carried out from the aspects of individual,family,school,unhealthy culture,situation and treatment factors.In addition to the minor’s own characteristics of impulsivity,uprightness,increased independence and lack of empathy,insufficient family education is an important cause of serious violent crimes for minors,which is mainly manifested in insufficient and unreasonable parental companionship and family education.The violence education method and the lack of effective monitoring,identification and intervention.In addition,the loopholes in school education management,the acquisition of bad culture,the stimulation of relevant situational factors,and the imperfect treatment measures all have a certain impact on the occurrence and development of serious violent crimes committed by minors.The fifth part is the improvement of the prevention and treatment countermeasures of serious violent crimes committed by minors in our country.Starting from the cause of crime,combining actual conditions,strengthening family education,joint management and control of education departments and schools,weakening negative cultural influence,reducing situational inducing factors,and accelerating the exploration of hierarchical treatment and other dimensions to provide comprehensive recommendations for prevention and control countermeasures.While better protecting the physical and mental health of minors,it is hoped that serious violent crimes committed by minors will be effectively prevented.
