Research On Digital Music Copyright In Short Video Production

Along with the development of Internet information technology,short videos have emerged under the promotion of technology.As a kind of new thing,there is a certain legal gap in the protection of copyright of short videos.Especially in the creation of short videos,the downloading and use of digital music may cause infringement to the copyright owner of digital music and seriously damage the interests of the copyright owner.In the current legal regulations,the interests of digital music copyright owners,users and short video platforms cannot be well balanced,which is not conducive to the development of China's short video industry in the long run.Therefore,it is of great practical significance to study the infringement of digital music applications in short video creation.In this study,the concept of short video and digital music is discussed,the relationship between short video and digital music is shown,and the role played by digital music in short video creation is discussed.By expounding on the determination of digital music copyright infringement in short video creation and the application of the principle of infringement defense in the current law,it shows the problems existing in the current law and practice.According to the constitutive elements of digital music copyright infringement in short video creation,different forms of infringement and the special problems of infringement in short video platform,the relevant infringement determination is analyzed.The defenses of infringers are also elaborated,and the application of fair use,default license and safe harbor principles are shown.Finally,relevant suggestions are made to further promote the development of China's short-form video industry.
