Since the “Internet +” era came in 2013,the Digital Music Industry which had been developing fast during the Internet era has achieved another blossom.The quickly-improved Internet technology,added with its gradually-deepened fusion with the Digital Music Industry,has led the Digital Music Industry into an exuberant “summer”.Nonetheless,the fast development of the Internet technology has also greatly challenged the legal protection of copyright of the digital music.The spring-up of cases where the Internet Search Service Provider infringement exists,the newly-born P2 P infringement exists,and the newly-born We Media infringement exists,together with the negative consequences due to the imbalanced distribution of the royalties of copyright of the digital music,makes the legal protection of copyright of the digital music in the “Internet+” era an emergent project of great importance.This thesis shows very detailed analysis and discussions upon this project.This thesis has seven main parts: “Introduction”;“the outlines of the protection of digital music copyright in the ‘Internet +' era”;“analysis upon the infringements of digital music copyright in the ‘Internet +' era”;“the overall ways of the legal protection of digital music copyright in the‘Internet +' era”;“the extensive discussion upon the protection of digital music copyright in the ‘Internet +' era”;and “Conclusion”.Considering that the U.S.A has an earlier start in such an area and has had a lot of meaningful cases,judgments as well as regimes,nearly all parts of this thesis have used the U.S.A relevant regimes,cases and laws to makecomparative analysis and research.In the second part,the author firstly defines the time periods of “the era prior to the Internet era”,“the Internet era” and “the Internet +” era,and then explains the definition,features as well as historical development of the digital music.Afterwards,the author mainly introduces and analyzes the two transformations in the American music history and the four stages of music copyright protection in China.After the comparative analysis and research,the author explains the need of reformation in the legal protection of digital music copyright in the “Internet +” era.And finally,the author makes an overall discussion on the legal protection of digital music copyright in the “Internet +” era,using the methods of historical approach and comparative analysis.Also in this part,the author has made profound analysis using different cases in China and the U.S..In the third part,the author deeply analyzes all kinds of different infringements of digital music copyright in the “Internet +” era,using different cases in China and the U.S.together with the perspective of technology.In the fourth part,the author discusses the overall ways of the legal protection of digital music copyright in the “Internet +” era from the following three aspects: information collection;collective stewardship of copyright;and the ways of copyright permission.In the fifth part,the author makes an extensive discussion of the legal protection of digital music copyright in the “Internet +” era from the perspective of IP benefit distribution.The legal protection of digital music copyright in the “Internet +” era is an emergent issue nowadays.The author of this thesis has come up with his own original solutions to this issue from the perspective of “law +technology” through rigorous analysis and detailed discussions following the logic chain above.
