With the advancement of technology,the Internet is playing an increasingly important role in people's lives.While the Internet has changed people's lifestyles,it has also brought new risks of privacy infringement.Aiming at the new characteristics of privacy in cyberspace,this article uses the judgment documents on the "www.pkulaw.cn" to sort out the status quo and characteristics of privacy infringements in the online environment.And from the three perspectives of the plaintiff,defendant,and court in the judgment,it analyzes the dilemma of protecting citizens' privacy at this stage.Finally,from the perspective of privacy subjects,technology,laws and regulations,government departments,and social organizations Recommendations for protecting citizens' privacy.The main contents of the research include:First,grasp the current status and focus of research on citizen privacy under the impact of the Internet and big data technology.To clarify the changes in privacy features from "biology" to "digital",and the changes in citizen cognition from "ignorance" to "value" to "paradox".Understand the typical types of privacy infringements in the Internet environment,and sort out the basic framework of privacy protection at this stage is the combination of citizen self-protection,privacy policy,legal and regulatory protection.According to the steps of the research,the first chapter comprehensively grasps the changes and trends of citizens' privacy,and provides the thinking context for the subsequent analysis based on the judgment document.Second,select judgment documents related to privacy infringement,and conduct detailed and repeated reading and combing.The NVIvo 11 plus tool was used to encode case samples from three perspectives: the plaintiff and the type of infringement,the defendant and the motive of the infringement,and the court decision.And mainly from the perspective of the types of infringement,in-depth analysis of the three types of privacy infringements in the network environment: "private life peace is disturbed","personal privacy is disclosed",and "personal information is violated".Third,proceeding from the overall judgment document,considering the relationship between the plaintiff,the defendant,and the court.In other words,it is to combine the coding results of the plaintiff and the infringement type,the defendant and the infringement motive,and the court judgment result to analyze the dilemma of protecting citizens' privacy in the network environment.Citizens' low awareness of privacy protection,the new threats brought by big data technology,and the lack of judicial and legislative aspects are the three major reasons why privacy protection is difficult.Based on the analysis of the status quo and predicament in the previous article,it provides reference suggestions for protecting citizens' privacy in the Internet age.There is no single factor that causes privacy violations.Infringers,government agencies and even individual citizens are all responsible.Therefore,protecting citizens' privacy in the network environment cannot rely on only one force.The protection of privacy requires the formation of a joint effort of citizens,institutions,industries,laws and regulations,and social organizations.
